The Procurement Act has now received Royal Assent, the culmination of its passage through parliament. It’s expected to come into force during October 2024. The new legislation will represent a significant transformation for the public procurement landscape.
A common theme of the communications attached to the new legislation, including the initial green paper, is that it represents a simplification of the rules and should help smaller businesses. The Act significantly reduces the number of procedures and introduces new principles of procurement. The Act also increases obligations for Contracting Authorities when it comes to transparency and has 13 notice types. Unlike the current regime, the new Act focuses on compliance with the procurement principles rather than laying out a detailed process for each of procedures.
In terms of the transition from the current rules to the new legislation, existing TPPL frameworks and dynamic purchasing systems will remain compliant and accessible until their stated expiration date.
